PLA Mandate Upheld by Federal Court

Following Appeal of Biden-Era Rule

ATLANTA—In a major victory for the nation’s building trades, the U.S. Court of Appeals for the Eleventh Circuit handed down a ruling on April 21 that affirmed the denial of a preliminary injunction to halt the Biden-era PLA mandate, which impacts projects receiving $35 million or more in federal funding.

The Associated Builders and Contractors and its Florida First Coast chapter filed the appeal for an injunction. Constructive Dive reports that in the court’s ruling, Chief Judge William Pryor said that the appeal would likely not succeed because the Office of Management and Budget issued a memo confirming the Biden-era order would remain, even under the Trump administration.

The executive order, signed by President Biden in February 2022, established a requirement that contractors and subcontractors on qualifying federal projects negotiate or become a party to a project labor agreement. Michael Bellaman, ABC president and CEO, said the ABC would continue to fight the mandate and at press time was “considering all legal options.” However, for now the federal PLA mandate remains in place.
