Empire City/MGM Resorts Envisions Late 2027 Opening if it Wins Downstate Casino License

YONKERS—The high stakes gamble to secure one of three casino gaming licenses in the New York metro area has reached a key milestone with eight players placing a $1-million bet that the cards will be drawn in their favor.

The New York State Gaming Facility Location Board received a total of eight applications in response to its Request for Applications for up to three Downstate casino gaming licenses before the 4 p.m. deadline on June 27. Each applicant had to submit a $1-million application fee to stay in the game.

One entrant that Hudson Valley business leaders and politicos are rooting for is the Empire City Casino by MGM Resorts property in Yonker, NY. MGM Yonkers Inc., a subsidiary of MGM Resorts International, announced it had submitted its commercial casino license application to the New York Gaming Commission and the Gaming Facility Location Board, with a $2.3-billion proposal to transform its historic Empire City Casino site into a commercial casino and entertainment destination.

If awarded a commercial casino license, MGM Yonkers anticipates completing all project elements with its expansion of Empire City Casino by MGM Resorts by mid-2029.

MGM Yonkers’ plans include the full renovation and expansion of Empire City Casino’s existing gaming areas, an expansive high-limit lounge and the addition of a state-of-the-art BetMGM Sportsbook offering retail sports betting. The plan also envisions the addition of a 5,000-person maximum capacity entertainment venue and accompanying meeting space which will welcome a variety of A-list and local performances with the design flexibility to accommodate special events, local graduations and other community needs, MGM Yonkers officials stated.

Additionally, three new full-service restaurants and the renovation of existing food and beverage venues are planned. A parking garage with solar energy arrays and electric vehicle parking spaces is also included in the casino plan. If MGM Yonkers is awarded a commercial casino license, it anticipates completing all project elements by mid-2029.

“Empire City Casino and Yonkers Raceway have anchored the entertainment and tourism culture in downstate New York for more than a century. Achieving a full casino license will ensure this site will continue to be a cultural and economic force for generations to come,” said Bill Hornbuckle, president and CEO of MGM Resorts International. Since opening in October 2006, Empire City Casino has generated more than $5 billion for New York State education, including $1.6 billion since MGM Resorts acquired the property in 2019.

If a license is awarded to Empire City, 20% of the generated tax revenue will be distributed, with 10% directed to the City of Yonkers, 5% to Westchester County, and 5% divided between Rockland and Putnam counties. The proposal estimates the project will ultimately create thousands of direct, induced and indirect jobs through the new economic activity that the commercial casino license would generate for the region.

On June 25, the Yonkers City Council unanimously approved the required zoning ordinance and zoning map amendment establishing the property at Empire City Casino by MGM Resorts (810 Yonkers Ave.) as a designated Casino District. The approval paved the way for the expansion of the existing property into a full-scale commercial casino with Class III slot machines, live-dealer table games and retail sports betting, pending New York State approval.

“Yonkers is on its way to winning big in spurring transformative economic growth, job creation, entertainment and more,” said Yonkers Mayor Mike Spano after the Council’s vote. “This vote signals to New York that the Yonkers site has speed to market readiness and is prepared to hit the ground running once licenses are granted. Working with our community members, city leaders and MGM Resorts, we have the support and commitment needed for this project to succeed right out of the gate — providing economic benefits for the city, county and state while making Yonkers a premier destination.”

The other seven casino license applicants include the existing Resorts World New York City casino at Aqueduct Racetrack in Jamaica, Queens; The Avenir at Hudson Yards in Manhattan; Bally’s New York Casino at Ferry Point in The Bronx; Caesars Palace Times Square at 1515 Broadway in Manhattan; Freedom Plaza at 686 1st Ave. in Manhattan; Metropolitan Park adjacent to Citi Field at Willets Point in Queens; and The Coney at Coney Island in Brooklyn.

Some analysts believe that the existing gaming facilities—Empire City Casino and Resorts World New York City—could have a leg up on their competition because they could become operational sooner.

In its application, MGM Yonkers noted that it can offer “Speed to Market,” stating: “If MGM Yonkers is awarded a commercial gaming license by year-end 2025, limited commercial gaming operations are estimated to begin in June 2027 and full commercial operations by November 2027. By the end of 2029, all envisioned components will be operational. Once complete, the property will consist of approximately 863,500sf of total development, including 282,100sf of fully renewed interiors and 359,200sf of new programming and amenities.”

The applicants, including MGM Empire City Casino will be working to secure all necessary approvals. In addition, Community Advisory Councils have been formed and will begin evaluating bids by holding public meetings and soliciting public comments.

The Gaming Facility Location Board is scheduled to make its final decision on casino applications by Dec. 1, 2025 with the New York State Gaming Commission awarding up to three casino licenses and collects a $500-million license fee from each award recipient by Dec. 31, 2025.

MGM Empire City Casino Project Highlights

Here are key points raised in MGM Empire City Casino’s application to the New York State Gaming Commission for a full-gaming license for its Yonkers facility.

“With an awarded license, MGM Yonkers would plan to reinvest $2.3 billion, which includes $1.8 billion of capital investments into the property. Our plan, which prioritizes speed-to-market and minimal operational disruption, is to meaningfully expand and remodel the existing property footprint while adding several amenities and new experiences that would continue to draw visitors to Yonkers.

As part of the investment, MGM Yonkers intends to give the property a unique architectural identity. As a midpoint between urban and natural landscape, the property would honor tradition but with a design oriented toward the future. The building would be reclad in a mix of modern metal paneling, screens, and softer stone or stone-like accents, seeking to bridge the urban settings of Yonkers and New York City with the landscapes of Westchester County and the Hudson Valley.”

Major components of MGM Yonkers’ proposal include:

  1. Arrival Experience: Outside the building, the existing porte cochere would be transformed with a sleek geometric canopy anchored by our iconic gold lion centerpiece.
  1. Casino: The existing casino floor will be fully revamped with an upscale, modern interior featuring mixed metals, pops of color and contrasting materials. The casino floor will include high-limit gaming spaces. We will continue the operation of our historic horseracing track as well as parimutuel operations, ensuring ongoing purse payments.
  1. Food & Beverage: Five new restaurant venues would be added, including a multi-concept Food Hall, and new beverage concepts featuring a center bar, a high limit lounge and two additional walk-up bars.
  1. The Theater and Meeting Space: Leaning further into what we do best, Empire City Casino would be expanded to include an entertainment venue with a maximum general admission capacity of 5,100 as well as an estimated 9,300sf of meeting space and prefunction spaces. The Theater, meeting rooms, and associated back-of-house spaces would total approximately 162,250sf of new development. We would leverage our reputation and expertise as a leading entertainment provider to welcome world-class performances and events.
  1. BetMGM Sportsbook: We would feature a sports betting retail location in partnership with BetMGM, our market-leading online sports betting joint venture operating in New York and throughout North America. The BetMGM Sportsbook would be a combination of redeveloped space and new build of approximately 10,100sf featuring seating, LED TV screens, and a full-service bar.
  1. Parking Garage: We would construct an approximately 4,800-space covered parking garage with direct access to the building and topped with solar energy arrays to achieve or exceed New York State’s requirement of 10% of energy from renewable sources.
  1. Employee Experience: The redevelopment would include employee and back-of-house areas with a new employee dining room, new locker rooms, break rooms, and offices. We would also develop a new employee administrative building supporting an on-site hiring center and table games dealer training school.

Tax Contributions – “If awarded a license, 80% of MGM Yonkers’ tax revenue will go to the New York State Education Fund. Because of the “Education Hold Harmless” requirement, if this amount falls short of our FY 2022 level of contribution ($315 million), we will be uniquely required to make up the shortfall (including during our construction period). The remaining 20% of our gross gaming tax revenue contributions will be split between the City of Yonkers (10%) and Westchester, Rockland, and Putnam counties (10%). We also will be obligated to continue funding substantial horse racing purses amounting to more than $70 million by Year 4 of operations 1 – something that does not apply to non-VGM Facility applicants. All of this results in an effective rate of tax that is 71% higher than the minimum prescribed rates (based on 2029 Average Pro Forma) and ensures a higher tax rate than what might otherwise be collected from other candidates,” MGM Yonkers stated in its application.

Employment Impacts – “We will work with our union partners and general contractors to encourage participation in the contracts and labor force needed to renovate and expand Empire City Casino. MGM Yonkers intends to meet New York State’s 30% MWBE and 6% SDVOB contract utilization rate for the project’s construction and ongoing capital projects,” MGM Yonkers stated.

In its application, MGM Yonkers stated that construction is estimated to generate approximately 3.8 million hours in construction labor with an estimated daily average of approximately 557 FTEs. “Due to the nature of construction work, with the labor of each trade being needed for specific periods of time during the overall construction period, we estimate this translates to 6,500 individual workers expected to work on site throughout construction,” MGM Yonkers stated in its application. In addition, MGM Yonkers noted that it would work with its union partners and general contractors to encourage participation in the contracts and labor force needed to renovate and expand Empire City Casino and intends to meet New York State’s 30% MWBE and 6% SDVOB contract utilization rate for the project’s construction and ongoing capital projects.

Revenue Projections – Based on the RFA’s revenue scenarios, MGM Yonkers is expected to annually generate between approximately $1.03 billion and $1.39 billion in gross gaming revenue, all of which is an increase of between approximately 92% and 129% over current video lottery terminal operations.
